What This Means (2025 FDD)
According to 7 Brew's 2025 Franchise Disclosure Document, 7 Brew states that franchisees are independent contractors and that 7 Brew will not exert control over the store's personnel or employment conditions. Franchisees are expected to manage their own employees, including selection, training, promotion, termination, pay rates, benefits, and working conditions. 7 Brew aims to avoid being considered the employer or joint employer of the franchisee's employees. However, 7 Brew does retain the right to exercise indirect control to protect the quality of products, services, and the 7 Brew brand.
This arrangement is typical in franchising, where franchisees operate as independent business owners. This independence allows franchisees to tailor their employment practices to local market conditions and employee needs. However, franchisees must still adhere to brand standards and operational guidelines set by 7 Brew to ensure consistency and quality across all locations.
Prospective franchisees should understand that while they have autonomy in managing their employees, they must also balance this with maintaining 7 Brew's brand standards. Franchisees should seek legal counsel to ensure their employment practices comply with all applicable laws and regulations, as they are solely responsible for these matters. This independence also means that franchisees bear the risks and responsibilities associated with employment decisions, such as potential liabilities from employee claims or disputes.
