What This Means (2025 FDD)
According to the 2025 360 Painting Franchise Disclosure Document, all advertising must be in a medium, type, format, and particular style approved by 360 Painting. Advertising must be conducted in a dignified manner and conform to 360 Painting's standards and requirements. Franchisees must submit any advertising and marketing materials not prepared or previously approved by 360 Painting at least 14 days before publication. 360 Painting may withhold approval for any reason. If 360 Painting does not notify the franchisee of approval or disapproval within 10 days of receipt, the materials are considered approved. Franchisees must discontinue the use of any approved advertising within five days of receiving a request from 360 Painting to do so.
Franchisees may not conduct advertising or promotion on the Internet, world wide web, or other electronic transmission via computer without 360 Painting's express prior written approval. All advertising and promotion must be factually accurate and shall not detrimentally affect the Marks or the System, as determined by 360 Painting. Franchisees must use the telephone number provided by 360 Painting in connection with all marketing initiatives.
These stipulations mean that a 360 Painting franchisee has limited autonomy over their advertising. They must adhere to the brand's standards and obtain approval for their advertising materials. This process could potentially slow down marketing efforts and limit creative freedom. However, it also ensures brand consistency and protects the 360 Painting brand image. The franchisee must also use the phone number provided by the franchisor for all marketing, ensuring calls are handled according to the 360 Painting system standards.
