What This Means (2025 FDD)
According to the 2025 360 Painting Franchise Disclosure Document, the franchisee is responsible for ensuring that any products or services used in the operation of their business comply with applicable law. This includes compliance with personnel laws and regulations. This means that the franchisee must stay informed about all relevant federal, state, and local laws governing employment, wages, workplace safety, and other personnel-related matters.
This responsibility extends to verifying that any products or services they use in their 360 Painting business operations adhere to all legal requirements. If a franchisee identifies a product from an approved supplier that does not comply with the law, they can propose an alternative product or supplier to the franchisor for approval, which the franchisor must act on within 10 business days.
For a prospective 360 Painting franchisee, this highlights the importance of due diligence and legal awareness. They should consult with legal counsel to understand their obligations as an employer and business operator. Additionally, they should establish procedures for regularly reviewing and updating their practices to ensure ongoing compliance. The franchisee bears the risk of non-compliance, so proactive measures are essential.
While the franchisor may offer guidance or resources, the ultimate responsibility for legal compliance rests with the franchisee. This underscores the importance of independent decision-making and risk management for franchisees in the 360 Painting system.
