">ITEM 14: PATENTS, COPYRIGHTS, AND PROPRIETARY INFORMATION
There are no patents of which we are aware that are material to the 360 Painting Businesses, and there are no patents pending. We own copyrights in the Brand Standards Manual, our estimating software, marketing materials and other copyrightable items that are part of the System. While we claim copyrights in these and similar items, we have not registered these copyrights with the United States Registrar of Copyrights and need not do so to protect them. You may use these items only as we specify while operating the Business, and you must stop using them if we direct you to do so. You must promptly tell us when you learn about any unauthorized use of copyrighted information. We have the right to control any litigation concerning our copyrighted materials. We are not obligated to protect your rights to use the copyrighted materials.
There are currently no effective determinations of the Copyright Office (Library of Congress) or any court regarding the copyrighted materials. Our right to use or license copyrighted items is not materially limited by any agreement or known infringing use.
We have developed certain Confidential Information, including certain trade secrets, methods of business management, sales and promotion techniques, and know-how, knowledge of, and experience in operating painting, decorating and wall finishing services businesses, and we may divulge this information in confidence to qualified franchisees and managers.

What This Means (2025 FDD)
According to the 2025 FDD, 360 Painting states that they are not aware of any patents that are material to the 360 Painting business, nor do they have any pending patent applications. However, 360 Painting does own copyrights to their Brand Standards Manual, estimating software, marketing materials, and other copyrightable items that are part of their system.
As a 360 Painting franchisee, you are allowed to use these copyrighted items as specified by the franchisor while operating your business. If directed by 360 Painting, you must stop using these items. Additionally, you are required to inform 360 Painting of any unauthorized use of their copyrighted information. 360 Painting retains the right to control any litigation concerning their copyrighted materials and is not obligated to protect your rights to use them.
The Franchise Disclosure Document specifies that all ideas, concepts, techniques, or materials concerning your 360 Painting business, whether or not they qualify as protectable intellectual property, must be promptly disclosed to 360 Painting. These will be considered 360 Painting's sole and exclusive property and part of the System, which they may choose to adopt and/or disclose to other franchisees. Similarly, 360 Painting will disclose to you concepts and developments from other franchisees that become part of the System. You are also obligated to assist 360 Painting in obtaining intellectual property rights for any concept or development if requested.
