What This Means (2025 FDD)

According to the 2025 360 Painting Franchise Disclosure Document, if a franchisee wishes to operate the business from a location other than their house, 360 Painting will consult with them and respond within 30 days. However, the franchisee must operate the 360 Painting business from their home until 360 Painting approves an alternative location in writing. If the franchisee and 360 Painting cannot agree on a site outside the franchisee's home, but the franchisee proceeds to operate at an unapproved site, 360 Painting may issue a default under the Franchise Agreement, which if not timely cured may result in the Franchise Agreement being terminated, the franchisee having to cease operating the Business and the franchisee forfeiting their initial franchise fee to 360 Painting.

360 Painting states that the criteria used in deciding whether to approve a location outside of the franchisee's home are whether (a) it is located within the Protected Territory (which will be designated in reference to the franchisee's home address), and (b) it is suitable for use of the equipment required in the Business and for storage of equipment and supplies. In all cases, the franchisee must operate their franchise only in the Protected Territory and only from their home office (or other approved office space) and their Vehicles, and their home office (or other approved office space) and all Vehicles must be located in the Protected Territory at all times.

360 Painting does not have to agree with the franchisee on a site if the franchisee operates from their home. 360 Painting will respond to the franchisee's request for approval within 30 days after the franchisee provides 360 Painting with the information necessary for 360 Painting to determine that it will otherwise satisfy their criteria. There is no time limit for 360 Painting to approve or disapprove a site. 360 Painting will not unreasonably withhold its approval of the franchisee's proposed location outside of their home. 360 Painting does not generally own the location of the franchisee's Business and does not provide any assistance to the franchisee in conforming the premises of their Business to local ordinances and building codes or obtaining any required permits.
