Answer from 2025 FDD Document

We may terminate the Brand Fund by giving you 30 days' prior written notice.

All unspent monies on the date of termination shall be divided between us and franchisees in proportion to the respective contributions during the 12 month period prior to termination.

At any time thereafter, we may reinstate the Brand Fund.

What This Means (2025 FDD)

According to 1 800 Packouts' 2025 Franchise Disclosure Document, if the Brand Fund is terminated, all unspent monies will be divided between 1 800 Packouts and its franchisees. The division will be proportional to the contributions made by each party during the 12-month period prior to the termination date. This means that if a franchisee contributed a larger percentage of the total Brand Fund in the year leading up to the termination, they would receive a correspondingly larger share of the remaining funds. Conversely, 1 800 Packouts would receive a portion of the unspent funds based on its contributions during that same period.

This arrangement ensures that both 1 800 Packouts and its franchisees have a vested interest in the responsible management of the Brand Fund. It also provides a mechanism for returning unused funds to those who contributed them, should the Brand Fund be discontinued. However, the FDD also states that 1 800 Packouts may reinstate the Brand Fund at any time after termination, which could potentially impact long-term marketing strategies and require franchisees to resume contributions.

For a prospective franchisee, this clause offers some financial protection in the event the Brand Fund is terminated. It is important to note that the distribution is based on contributions over the prior 12 months, so recent contributions will have a greater impact on the amount received. Franchisees should also be aware that 1 800 Packouts has the right to reinstate the Brand Fund, which could lead to further contributions being required in the future.
