What This Means (2025 FDD)
According to the 2025 1 800 Packouts Franchise Disclosure Document, a franchisee faces specific restrictions on operating outside their designated territory, referred to as an "Excluded Territory." Generally, franchisees are prohibited from operating a facility, advertising, or directly marketing to customers within an Excluded Territory. They also cannot solicit referrals from referral sources for customers located within an Excluded Territory. These limitations are in place to protect the territorial rights of other franchisees or areas reserved by 1 800 Packouts itself.
However, the 1 800 Packouts franchisee can market to and solicit referrals from insurance agents, adjusters, mitigation companies, contractors, property management companies, and other similar referral sources located in an Excluded Territory if these referral sources have customers, clients, or properties within the franchisee's own territory. In such cases, the franchisee must inform these referral sources that they are only seeking referrals for customers or properties located within their territory or an unowned territory.
Furthermore, a 1 800 Packouts franchisee can provide services in an Excluded Territory only if a referral source or customer directly requests their services, if 1 800 Packouts authorizes or requires them to provide services after a Catastrophic Event, or if 1 800 Packouts authorizes them to provide services to National Accounts. These exceptions allow for flexibility in serving customers and addressing needs that may arise outside the franchisee's primary territory under specific conditions and with the franchisor's approval.
