At any time before the Franchised Business opens for business, you (or your Operating Principal) and your Manager (if you appoint one) must complete System/Procedure Training to our satisfaction. If we determine in our sole discretion that you or your Manager are unable to satisfactorily complete System/Procedure Training, we may, at our option, require you or them to retake System/Procedure Training or terminate this Agreement upon written notice to you, in which case we will not refund any fees paid by you.

Additional Training. We may require that you, your Manager, and/or other key personnel that we designate to attend optional or mandatory refresher training and/or ongoing educational training, seminars, conferences, webinars, other electronic communications and regional or national meetings, huddles, and meetings relating to the operation of Franchised Businesses at locations we select. There are certain certifications which you may desire to have your employees obtain. Having employees with various certifications can provide certain benefits to your Franchised Business. We may charge you a reasonable fee for each of your trainees required or scheduled to attend such programs and conferences regardless of whether such employees actually attend. You will be obligated to bear the cost of wages and any travel and living expenses incurred by you or your trainees related to any such programs and conferences. If we conduct training at your Franchised Business, you will be responsible for reimbursing us for the living and travel expenses of any of our representatives providing such training.

Training By You. You must hire all employees and staff of the Franchised Business, be exclusively responsible for the terms of their employment and compensation, and be exclusively responsible for ensuring that such employees and staff are trained in accordance with the System in the proper operation of the Franchised Business. You acknowledge that you, and not us, are the employer for any employees or personnel of the Franchised Business. We will not provide any hiring assistance, advice or guidance.

ITEM 12 TERRITORY

You will be granted a territory ("Your Territory"). Your Territory will not be exclusive. You may face competition from other franchisees, from company-owned businesses, or from other channels of distribution or competitive brands that we control. Your Territory will be described in an exhibit to the Franchise Agreement and will be determined in our sole discretion based upon population density, demographics and other Franchised Business operations in the market. Territories may range from 1 to 1,000,000 people. Your Territory may not exceed a population of 1,000,000 people, in the event the population exceeds 1,250,000 people you will be required to purchase an additional franchise.

You receive certain marketing protection afforded you under the Agreement, and in consideration of your participation in our national/regional programs. Such are collectively referred to as our National/Regional Opportunity Protection program or "NROP." As we enroll insurance companies, third-party administrators, or other similar organizations in this NROP program for the benefit of the System, our objective is to benefit our franchisees;

What This Means (2025 FDD)

According to the 2025 1 800 Packouts FDD, if a franchisee appoints a manager, that manager must complete System/Procedure Training to the franchisor's satisfaction. If the franchisor determines that the manager cannot satisfactorily complete this training, they may require the manager to retake it or terminate the Franchise Agreement.

1 800 Packouts may also require the manager to attend optional or mandatory refresher training, ongoing educational training, seminars, conferences, webinars, other electronic communications, and regional or national meetings. The franchisee is responsible for the costs of wages, travel, and living expenses incurred by the manager for these programs and conferences. If 1 800 Packouts conducts training at the franchise location, the franchisee must reimburse them for the living and travel expenses of their representatives.

If a 1 800 Packouts franchisee's manager ceases employment and neither the franchisee nor the Operating Principal can supervise the business, a new manager must attend and successfully complete System/Procedure Training within 60 days of the previous manager's termination. The franchisee is responsible for ensuring that all employees and staff are trained in accordance with the 1 800 Packouts system.
