Your marketing protections are governed by the following provisions referred to as your National/Regional Opportunity Protection (or "NROP"):

    1. Protected Advertising. No other 1-800-Packouts business may advertise in Franchisee's Territory in print, media, door-to-door, mass electronic communication, or direct web-based advertising within such Territory. It is acknowledged that Franchisee may experience some indirect/carry-over advertising from other franchisees in media where the reach of advertising is difficult to restrict to zip codes, such as radio or indirect web-based advertising—none of which shall comprise a breach of this provision.
    1. Protected TPA and Regional/National Referrals. Franchisee will receive TPA and Regional/National referrals for your assigned zip codes in accordance with program requirements. The Franchisor cannot guarantee the Franchisee's participation in these programs, nor can we guarantee any number of jobs from these programs. What This Means (2025 FDD)

According to 1 800 Packouts' 2025 Franchise Disclosure Document, the franchisor and its affiliates retain the right to advertise Franchised Businesses and related products/services using the Marks within a franchisee's territory. This includes advertising at home shows, trade fairs, exhibitions, and similar events. However, no other 1-800-Packouts business may advertise in a franchisee's territory in print, media, door-to-door, mass electronic communication, or direct web-based advertising within such Territory. Franchisee may experience some indirect/carry-over advertising from other franchisees in media where the reach of advertising is difficult to restrict to zip codes, such as radio or indirect web-based advertising—none of which shall comprise a breach of this provision.

This means that while 1 800 Packouts franchisees are granted an exclusive territory, the franchisor can still conduct advertising and promotional activities within that territory. This could potentially lead to competition for customers within the franchisee's own territory, as the franchisor could be promoting company-owned locations or other franchisees. However, the franchisee is responsible for local advertising and marketing tailored to their specific territory.

This reservation of rights allows 1 800 Packouts to maintain control over brand marketing and promotion, and to adapt its strategies as needed. For a prospective franchisee, it's important to understand that while you have territorial protections against other franchisees advertising in your territory, 1 800 Packouts itself can still advertise and market within your territory. Franchisee may not advertise or establish an office outside the Territory without Franchisor's prior written consent. Within the Territory, the Franchisee have the right to advertise, market, solicit and service any customer desiring inventorying, packing, moving, cleaning, deodorizing and storage services except as described in this section.

It is also important to note that the franchisee must obtain 1 800 Packouts' advance written approval prior to using or producing any advertising or marketing materials using any of the Marks, in whole or in part. 1 800 Packouts has final decision on all creative development of advertising and promotional messages. If written approval is not received within 14 days from the date 1 800 Packouts received the material, the material is deemed disapproved. 1 800 Packouts reserves the right to require the franchisee to discontinue the use of any advertising or marketing materials.
