What is the required action after a temporary injunction is granted to 1 800 Packouts?

Answer from 2025 FDD Document

To the extent that either of us seeks injunctive relief before the face-to-face meeting or mediation, the same may be applied to a court of competent jurisdiction. The court will hear only the application for injunctive relief, and the mere fact that the court exercised jurisdiction in considering the injunction will not serve to eliminate the alternative dispute resolution requirements of this Article. If the temporary injunction is granted, then the Party that made the application must begin the alternative dispute resolution process under this Article.

What This Means (2025 FDD)

According to the 2025 1 800 Packouts Franchise Disclosure Document, if 1 800 Packouts seeks injunctive relief and a temporary injunction is granted, 1 800 Packouts must begin the alternative dispute resolution process. This process is outlined in Article 17.

This means that if 1 800 Packouts goes to court to get a temporary order (injunction) to protect its interests, such as its trademarks or intellectual property, and the court grants that order, 1 800 Packouts can't just stop there. They have to then start a formal process to try and resolve the issue outside of court.

This requirement ensures that even if 1 800 Packouts gets a quick legal win with a temporary injunction, they still need to engage in good-faith efforts to find a more lasting solution through methods like mediation or arbitration, as detailed elsewhere in the franchise agreement. This encourages a balanced approach to resolving disputes, combining immediate legal protection with a commitment to alternative resolution methods.
