What This Means (2025 FDD)

According to the 2025 1 800 Packouts Franchise Disclosure Document, 1 800 Packouts has the ability to reinstate the Brand Fund at any time after it has been terminated. The FDD states that 1 800 Packouts may terminate the Brand Fund by providing franchisees with 30 days' prior written notice. Upon termination, any unspent funds will be divided between 1 800 Packouts and its franchisees, with the distribution being proportional to their respective contributions over the 12-month period preceding the termination.

This provision gives 1 800 Packouts significant flexibility in managing the Brand Fund. While the Brand Fund is intended to maximize recognition of the 1 800 Packouts marks and support franchised businesses, 1 800 Packouts is not obligated to ensure that advertising expenditures are proportionate to contributions from specific geographic areas or that all franchisees benefit equally from the advertising and marketing materials developed.

The ability to reinstate the Brand Fund after termination provides 1 800 Packouts with the option to resume marketing and advertising efforts using pooled franchisee contributions, should they deem it beneficial for the brand. For a prospective franchisee, this means that while the Brand Fund might be terminated and its assets distributed, it could be re-established in the future, requiring renewed contributions to the fund. Franchisees should stay informed about the status of the Brand Fund and be prepared for potential changes in its management.
