What This Means (2025 FDD)
According to the 2025 1 800 Packouts Franchise Disclosure Document, the Rider to the Franchise Agreement for use in Washington is signed because the franchised business will be located in Washington, the franchisee is a resident of Washington, or any of the offering or sales activity relating to the Franchise Agreement occurred in Washington.
The Rider modifies the Franchise Agreement to include recognition of the requirements of the Washington Franchise Investment Protection Act. Specifically, it notes that the state of Washington has a statute, RCW 19.100.180, that might supersede the Franchise Agreement, especially concerning termination and renewal. The rider also mentions the potential for court decisions to supersede the agreement in those same areas.
In the event of a conflict of laws, the Rider clarifies that the provisions of the Washington Franchise Investment Protection Act, Chapter 19.100 RCW, will take precedence. This ensures that franchisees operating in Washington are protected by Washington's franchise laws, even if other parts of the agreement might suggest otherwise.
