What This Means (2025 FDD)

According to the 2025 FDD, 1 800 Packouts formulates, develops, produces, and conducts advertising or promotional programs. 1 800 Packouts may also make available approved advertising and promotional materials, including signs, posters, and collaterals, for franchisees to purchase. Franchisees are required to contribute up to 3% of their gross sales to the Brand Fund, which 1 800 Packouts administers. The funds are used for various media, public relations, business development, and brand awareness initiatives. All advertising and marketing materials will be prepared by 1 800 Packouts or by outside advertising/public relations/promotional agencies.

1 800 Packouts, or its affiliates, may establish and operate websites, social media accounts, applications, and other means of digital advertising to promote the brand and franchise businesses. Franchisees are generally not allowed to conduct digital marketing using the brand's marks without written consent. If franchisees are permitted to engage in digital marketing, they must adhere to 1 800 Packouts' policies and standards. Franchisees are not authorized to have a website for their franchised business, as 1 800 Packouts will operate and maintain the brand website.

For local marketing, 1 800 Packouts requires franchisees to assign an employee to focus on local marketing efforts. Franchisees must conduct all advertising in a dignified manner and adhere to the standards specified in the manuals. 1 800 Packouts retains the final decision on all creative development of advertising and promotional messages, and franchisees must submit samples for approval, with materials deemed disapproved if written approval is not received within 14 days. 1 800 Packouts reserves the right to require franchisees to discontinue the use of any advertising or marketing materials at any time.

1 800 Packouts may establish advertising cooperatives in geographic areas with multiple franchise businesses. These cooperatives, with 1 800 Packouts' approval, administer advertising programs and develop marketing materials for their respective areas. Franchisees are required to join any cooperative in their area and contribute the amounts determined by the cooperative, which will be credited toward their local advertising expenditures. 1 800 Packouts currently does not have an advisory council composed of franchisees to advise on advertising policies, but may establish one in the future.
