What This Means (2025 FDD)

According to the 2025 1 800 Packouts FDD, a portion of franchisee fees are allocated to national branding funds. These funds are specifically designated for marketing and advertising initiatives, as outlined in the franchise agreements. The aim is to boost brand recognition and drive customer traffic to franchised businesses.

1 800 Packouts retains significant control over how the Brand Fund is managed and spent. The company decides when, how, and where the funds are allocated, including the types of media used and the location of advertising campaigns. These media channels can include print, radio, television, telephone, smart phone, social media, and the Internet. Funds may also support public relations, the development of marketing materials, wages for digital marketing staff, and brand awareness initiatives like trade shows and other events.

While 1 800 Packouts endeavors to develop advertising and marketing materials, the FDD clarifies that the company is not obligated to ensure that expenditures in any specific geographic area are proportionate to the contributions from franchisees operating in that area. Nor is 1 800 Packouts obligated to ensure that any franchisee will benefit directly or proportionally from the advertising and marketing materials developed. The advertising produced by the Brand Fund may be local, regional, or national in scope. An annual, unaudited statement of monies collected and costs incurred by the Brand Fund will be made available to franchisees upon written request.

1 800 Packouts also has the option to terminate the Brand Fund with 30 days' written notice to franchisees. In the event of termination, any unspent monies will be divided between 1 800 Packouts and its franchisees in proportion to their contributions during the 12-month period prior to termination. 1 800 Packouts may reinstate the Brand Fund at any time thereafter.
