What This Means (2025 FDD)
According to the 2025 1 800 Packouts Franchise Disclosure Document, franchisees do not have any ownership rights to the confidential information provided by the company. The FDD states that all rights, titles, and interests in the confidential information are owned by 1 800 Packouts and its affiliates. Franchisees are explicitly prohibited from claiming any ownership or rights to this confidential information. This includes manuals, trade secrets, know-how, methods, training materials, management procedures, marketing and pricing techniques, and other confidential information related to the franchised business or 1 800 Packouts's business.
This lack of ownership extends to marketing plans, advertising plans, business plans, financial information, customer information, employee information, and independent contractor information. Franchisees are only permitted to use this information to perform their duties as a franchisee. They cannot disclose it to anyone outside the organization, nor can they use it for any purpose other than operating their 1 800 Packouts franchise.
Upon termination of the franchise agreement, franchisees must return all records and confidential information to 1 800 Packouts, without retaining any copies. This underscores that the confidential information remains the exclusive property of 1 800 Packouts, ensuring that franchisees cannot use it to compete with the company or other franchisees after their agreement ends. This is a common practice in franchising, as the franchisor's proprietary information is a key component of the franchise system's value.
