If, as of the time you sign this Agreement, we have established a Cooperative for the geographic area in which the Franchised Business is located, or if we establish a Cooperative in that area during the Term, you agree to sign the documents we require to become a member of the Cooperative and to participate in the Cooperative as those documents require. You agree to contribute to the Cooperative the amounts determined by the Cooperative. Such amounts will not be counted toward your local advertising obligation in Section A. (Advertising By Franchisee).

What This Means (2025 FDD)
According to the 2025 FDD, 1 800 Packouts may establish regional advertising cooperatives. If a cooperative is established in the franchisee's area, either when the franchise agreement is signed or during the term of the agreement, the franchisee must sign the documents that 1 800 Packouts requires to become a member and participate in the cooperative.
This means that franchisees do not have a choice about joining the cooperative if one exists or is created for their area. They are obligated to sign the required documents and participate as specified. The specific documents are not named in the FDD, but franchisees should expect legal agreements outlining their responsibilities and the cooperative's rules.
Franchisees are also required to contribute to the cooperative, with the contribution amounts being determined by the cooperative itself. However, these contributions do not count towards the franchisee's local advertising obligations, meaning franchisees must budget separately for both cooperative and local advertising expenses. This mandatory participation and financial contribution are important factors for prospective franchisees to consider when evaluating the overall cost and obligations associated with a 1 800 Packouts franchise.
