We may periodically formulate, develop, produce, and conduct, at our sole discretion, advertising or promotional programs in such form and media as we determine to be most effective. We may make available to you for you to purchase approved advertising and promotional materials, including signs, posters, collaterals, etc. that we have prepared. We or our affiliates will retain all copyrights relating to such advertising materials.

This means that while franchisees are required to engage in local advertising and marketing tailored to their specific territory, 1 800 Packouts maintains control over the broader advertising and promotional strategies. Franchisees must also obtain written approval from 1 800 Packouts before using any advertising or marketing materials that feature 1 800 Packouts's marks. This ensures that all advertising aligns with the brand's standards and requirements, as outlined in the manuals. 1 800 Packouts has the final say on the creative development of advertising and promotional messages and can require franchisees to discontinue using any advertising or marketing materials.
Additionally, 1 800 Packouts may establish regional advertising cooperatives where multiple franchised businesses are located. These cooperatives, formed, modified, or dissolved at 1 800 Packouts's discretion, administer advertising programs and develop marketing materials for their respective areas, subject to 1 800 Packouts's approval. Franchisees are required to participate in these cooperatives and contribute financially as determined by the cooperative. 1 800 Packouts may also establish a franchisee advisory council to facilitate communication between the company and its franchisees regarding marketing activities, with franchisees expected to participate and cover associated expenses.
