Answer from 2025 FDD Document

(1) You agree to use in the development and operation of the Franchised Business the management system, computer hardware, mobile devices, applications, and software ("Management Systems") that we specify from time to time.

You acknowledge that we may modify such specifications and the components of the Management Systems from time to time.

As part of the Management Systems, we may require you to obtain specified computer hardware, mobile devices, and/or applications or software, including, without limitation, a license to use proprietary software developed by us or others.

We may also require that all or parts of the Management Systems be purchased or contracted through us or our designee.

Our modification of such specifications for the components of the Management Systems may require you to incur costs to purchase, lease and/or license new or modified computer hardware, mobile devices, and/or software and to obtain service and support for the Management Systems during the term of this Agreement.

You acknowledge that we cannot estimate the future costs of the Management Systems (or additions or modifications thereto) and that the cost to you of obtaining the Management Systems (including software licenses) (or additions or modifications thereto) may not be fully amortizable over the remaining term of this Agreement.

Nonetheless, you agree to incur such costs in connection with obtaining the computer hardware and software comprising the Management Systems (or additions or modifications thereto).

What This Means (2025 FDD)

According to the 2025 FDD, 1 800 Packouts franchisees must use the specified management system, computer hardware, mobile devices, applications, and software in the development and operation of their franchised business. These items are collectively referred to as "Management Systems." 1 800 Packouts may modify the specifications and components of these Management Systems over time, requiring franchisees to adapt to these changes.

As part of the Management Systems, 1 800 Packouts may require franchisees to obtain specific computer hardware, mobile devices, and software, potentially including licenses for proprietary software developed by 1 800 Packouts or others. Franchisees might be obligated to purchase or contract these systems through 1 800 Packouts or their designee. Modifications to the Management Systems may lead to additional costs for franchisees, as they may need to purchase, lease, or license new or modified hardware and software, as well as secure ongoing service and support.

The 1 800 Packouts FDD acknowledges that the future costs associated with the Management Systems, including any additions or modifications, cannot be accurately estimated. The costs for obtaining and maintaining these systems, including software licenses, may not be fully amortizable over the remaining term of the Franchise Agreement. Despite these potential financial burdens, franchisees must agree to incur these costs to comply with 1 800 Packouts' requirements for the Management Systems.

This requirement ensures that all 1 800 Packouts franchises operate using standardized and potentially updated technologies and systems, which can help maintain brand consistency and service quality. However, it also places a financial responsibility on the franchisee to stay current with the franchisor's technological requirements, regardless of the cost or amortization potential. Prospective franchisees should carefully consider these ongoing technology expenses when evaluating the overall investment and profitability of a 1 800 Packouts franchise.
