Can 1 800 Packouts change or modify any data on the franchisee's Management Systems?

We shall have independent access to data on your Management Systems, including Gross Sales figures.
There are no contractual limitations on our right to access this information and data; however, we will not be able to change or modify any data on the Management Systems.
We may, as outlined in the Operations Manual, require you to use certain designated software for accounting or bookkeeping purposes.
Your use of such software is a condition to your franchise, and in connection with such use, you must furnish to us no less than Viewing access to such software, together with all required reports as set forth herein.
If we designate required accounting software, you must use such software from any designated vendor(s) as set forth in the Operations Manual.
Such software use may include fees paid directly to such vendor(s), on such terms that they set.
- (2) You acknowledge and agree that changes to technology are dynamic and not predictable within the term of this Agreement.
In order to provide for inevitable but unpredictable changes to technological needs and opportunities, you agree that we shall have the right to establish, in writing, reasonable new standards for the implementation of technology in the System, and you agree to abide by those reasonable new standards we establish as if this Section D were periodically revised by it for that purpose.
- (3) You also must comply, at your expense, with all laws, industry standards, and payment card provider standards relating to the security of the Management Systems and data collected from customers, including, without limitation, the Payment Card Industry Data Security Standards.
You are responsible for any and all consequences that may arise if the system is not properly operated, maintained and upgraded, if the Management Systems (or any of its components) fails to operate on a continuous basis or as we or you expect, or if there is a data breach.

What This Means (2025 FDD)
According to 1 800 Packouts' 2025 Franchise Disclosure Document, while 1 800 Packouts has independent access to the data on a franchisee's Management Systems, including Gross Sales figures, they are contractually restricted from changing or modifying any of the data within those systems. This access allows 1 800 Packouts to monitor performance and ensure compliance with System standards.
However, 1 800 Packouts retains the right to charge a reasonable systems fee for software or system modifications and enhancements specifically made for them that are licensed to the franchisee, as well as for maintenance and support services related to the Management Systems. Furthermore, 1 800 Packouts may require franchisees to use certain designated software for accounting or bookkeeping purposes, as outlined in the Operations Manual, and the franchisee must grant 1 800 Packouts viewing access to this software along with required reports.
As technology evolves, 1 800 Packouts can establish new, reasonable standards for technology implementation within the System. Franchisees must comply with these standards at their own expense, and also adhere to all laws, industry standards, and payment card provider standards related to the security of Management Systems and customer data, including the Payment Card Industry Data Security Standards. Franchisees bear the responsibility for any consequences arising from improper operation, maintenance, or upgrades of the system, system failures, or data breaches.
