What This Means (2025 FDD)
According to the 2025 FDD, the Brand Fund for 1 800 Packouts can be used for general public relations. The FDD specifies that 1 800 Packouts may use the Brand Fund for general public relations, along with other activities aimed at building brand awareness. These activities include the development of advertising and marketing materials, wages for digital marketing, graphic design, and marketing initiatives, as well as participation in trade shows and other events.
This means that a portion of the 3% of monthly gross sales that franchisees contribute to the Brand Fund could be allocated to public relations efforts managed by 1 800 Packouts. Franchisees should be aware that 1 800 Packouts has sole discretion over how the Brand Fund is spent, including the selection of media and the location of advertising campaigns.
While 1 800 Packouts aims to maximize recognition of the Marks and patronage of Franchised Businesses, it is not obligated to ensure that expenditures from the Brand Fund are proportionate to the contributions from franchisees in any specific geographic area. Franchisees are entitled to receive an annual, unaudited statement of monies collected and costs incurred by the Brand Fund upon written request.
